The 43 year old is said to have lost control of his black Mercedes ML on the M40 near Warwick just after 3.30am on Wednesday
A police spokesman said: "A 43-year-old man was arrested on suspicion of driving with excess alcohol."
Merson is not too popular amongst Wigan Athletic supporters as he is often seen on Soccer Saturdya making belittling comments about the club.
The former Arsenal and England star has certainly found his level.
