Gutierrez facing race against time to be available for Newcastle's crunch clash

Newcastle midfielder Jonas Gutierrez is facing a race against time to be available for his side's relegation fight against Portsmouth tonight.[LNB]The Argentina international was forced to appear in a Spanish court today, which delivered a blow to the crisis club and ordered them to pay £5 million for his services.[LNB]Newcastle boss Alan Shearer is now sweating on the midfielder facing no delays on his way back to Tyneside as he prepares to name him in the side to meet Pompey.[LNB] Jonas Gutierrez in action for Newcastle against Tottenham earlier this month[LNB]The court in Mallorca has set the £5m fee for the winger, nine months after his arrival at St James's Park.[LNB]Half of the payment will go to his last club Real Mallorca, who were claiming £13.5m from Newcastle.[LNB]The other 50 per cent is owed to Velez Sarsfeld, the Argentine club who owned 50 per cent of his registration.[LNB]Newcastle signed Gutierrez came to Tyneside claiming to have legitimately left Mallorca under the terms of FIFA's Article 17 - otherwise known as the Webster Ruling, a reference to former Hearts player Andy Webster, who fought for the right to move to Wigan Athletic four years ago.[LNB]Newcastle can appeal against the Spanish court ruling to the Court of Arbitration for Sport but have made no announcement on their next move.
