Cherries: Judge expects to make decision over Piper loan tomorrow

05 November 2009 18:40
A CIVIL Court trial involving Cherries vice-chairman Jeff Mostyn and John Piper, the club's former company secretary, is tomorrow due to reach its conclusion.[LNB] The dispute between the pair centres on a £30,000 loan made by Piper just days before the directors of AFC Bournemouth were forced to call in the administrators in February 2008.[LNB] Piper is pursuing Mostyn personally for the funds, while Mostyn's defence claims the loan was made to the club so he is not personally liable.[LNB] At the time the loan was made, Mostyn held the post of chairman, having gained a controlling interest in the club, together with associate and co-owner Steve Sly, in March 2007.[LNB] Sly and then-company secretary Peter Schofield, who also made loans at the same time, both gave evidence in court in support of Mostyn.[LNB] Ernie Battey and David Musker, who were both Cherries directors when the loans were made, gave evidence in support of Piper.[LNB] Counsels for both parties finished their respective submissions earlier today at Southampton County Court before Mr Recorder Tyson said he expected to give his decision tomorrow morning.[LNB]
